Vestibular Function Tests,with Recording(eg,ENG) 92540-92548

Can an we bill an E&M service to the same patient on the same day of a vestibular testing(92540-92548). I checked the CCI and the E/M codes for office and inpatient are listed with a deleted date and a (9) modifier, which I think, indicates that you can bill for the E/M on the same date of the procedure without the 25 modifier. Please help!-thanks

Yes, it should be reported, as global period indicator is (xxx) means global concept does not apply for this code. But what I could suggest you is if the E/M service is after the vestibular testing (2nd session) and not related to the test, you should code appropriate level of E/M and should append -25 modifier saying that the E/M service is significant and separate from the test. If you will not append -25, payer will think that it's inclusive with the test as both are on the same DOS and you may not get reimburse for the E/M service.
