Vasectomy - discontinued

We had a patient that came in to the office for a vasectomy. In summary this is what happened:

After prepping him, manipulation and injection of local anesthetic into one site, he got significantly dizzy and diaphoretic with some nausea. He felt as though he was going to pass out. We elected to abort the procedure.

Can this be billed with a modifier 53? We have a few different opinions on this. Can we bill 55250 with 53 modifier?
