Can someone please clarify if it is fraud to bill a UA with a 59,qw modifier????

We can use only a modifier 59 with UA, but not QW, because it is not a CLIA-waved test.

It depends on the UA you are performing as well. Certain UA's are CLIA waived and you would apply the QW. Examples: 81002 and 81003 and also 81025 for a UA pregnancy test.
