Reporting Only Modifiers

Title 22 states a 2nd assist is required when performing a cardiovascular bypass procedure, but Medicare does not honor this ruling, and will not pay for a second assist. Therefore making it appear unnecessary to submit a claim for the services of the 2nd assist. However, we are being told by a seasoned biller/coder, we should still submit the claim with a medicare "reporting only" modifier. Do you agree? And if so, what would the appropriate modifier be?

The appropriate modifier is 8P(The 8P reporting modifier is available for use only with CPT II codes to facilitate reporting a denominator eligible case when an action described in a measure is not performed and the reason is not specified.)
