Impression:
1. Non-healing Wagner III diabetic right plantar foot wound with soft tissue infection
2. Venous Insufficiency

** This patient is being referred for hyperbaric oxygen therapy with an approved indication of Wagner 3 diabetic foot ulcer. So, the codes would be 250.80 / 707.19.

My QUESTION is what to do with the venous insufficiency dx as it is 459.81 requires a second ulceration code??... (So does the 250.80)

In ICD-9 manual, under code venous insufficiency 459.81, saying use additional code for any associated ulceration (707.10-707.9) and under 250.80, also saying any associated ulceration, use code (707.10-707.9). So use only once for 707.19 that is diabetes with any associated ulceration. I think no need any additional ulceration code for venous insufficiency as same code is already you are using in diabetes. Look also under Dx code 707.14, plantar surface of mid foot, which is included in ulcer of heel and midfoot.
