Mod 57 apply?

Patient is inpatient/Medicare primary - patient is new to us.

GI Doctor has done:

99222
43239

patient was advised of contraindications - patient understood and agreed to the surgical procedure - which in my mind, mod 57 applies..

yea or nay?
Wouldnt mod 57 apply to 43239?

Correction - I meant to say the mod 57 should be put on the 99222...... (ugh - waiting for caffeine to hit the brain)

Yes, mod 57 can be added to 99222 as that E&M service resulted in the decision making for the Sx.
