Foraminotomy Only w/ screw removal

The doctor removed a screw at the L5. He then did a left-sided Foraminotomy to ensure there was no damage to the nerve root. Because of the weakness the screw was left out on the left side and rods were replaced and connected for the L4-S1. I cannot bill for the L5 screw removal, since the rods placed go through that location, correct? Would this be CPT codes: 22849 (for the rod placement) and 63030 w/ mod -52, since only a foraminotomy was done?
