est pt being seen for new problem

Medicare denied billing of 99203 - pt was seen in 3yr time period - but visit unrelated to other visits. As clearly not a followup visit, but new condition, billed 99203 - do you agree? and if so should modifier be used and if so, which one?

Regardless of the problem being unrelated to the prior complaint, you may not bill a new patient visit within the 3 year time frame under the same Tax Id
