Billing hospital visit and office visit same day

Medicare has denied our claim with code 99234 with reason being another physician billed 99213 the same day and that physician was already paid by Medicare. Is there a modifier I can use so that our office is paid as well?

Does both physician belongs to same group practice with same speciality. If yes, then only one evaluation and management service may be reported unless the evaluation and management services are for unrelated problems.

Two physician can bill for E/M on same date of service, if the physicians are each responsible for a different aspect of the patient’s care, the physicians are in different specialties and the visits are billed with different diagnoses.
