ACP - 99497 by telephone

If a patient is intubated in the ICU and the palliative care provider speaks with the patient's family by telephone can an ACP (99497) be billed. If not what code can be used to bill the ACP that was performed. Can the inpatient consult (99223 Medicare) and code 99441 be used to billed the telephone conversation with the family. Please advice. Thanks

When the provider discusses and shares planning with a patient, his family, or an individual representing the patient, regarding the future health care needs of the patient, report code 99497 for the first 30 minutes of face to face time that the provider spends. Telephonic conversation cannot be considered an ACP. This will be considered as part of the evaluation and management provided in the hospital.

 

The telephonic call cannot be related to an E/M that occurred within the last seven days. So, code 99441 cannot be billed in this scenario.
