  1. Patient is seen by Dr Jones & the decision is made for surgery. A change is made in the provider treating the patient to Dr. Smith. Can Dr. Smith bill an E/M code even though the surgery is already scheduled?

  2. When Dr. Smith is a different physician and providing some level of E/M service to the patient at pre-Sx stage, you can bill for his visit. Only point to remember is that he should have documented the change in Dx (or Tx plan, whatever) clearly.

  3. And if the dx/tx is the same? Dr. Smith is now doing the surgery, but has never seen the patient so he does his own exam - can he bill for it?
